1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Saivy website and services ("Service"). By accessing or using Saivy, you agree to be bound by these Terms. If you do not agree, you must not use our Service.
Saivy is operated from Australia and these Terms are governed by Australian law.
2. Service Description
Saivy is an AI-powered tool that helps Australian consumers find and compare plans across mobile phone, home internet, health insurance, and energy providers. Our Service:
- Gathers publicly available plan information from provider websites using automated scraping technology.
- Uses artificial intelligence (including third-party AI services such as OpenAI) to extract, analyse, and rank plan details based on information you provide.
- Presents comparison results to help you identify plans that may be suitable for your needs.
Saivy is designed solely to make it easier for you to find and compare publicly available plan information. We are not a provider, broker, reseller, or intermediary for any of the plans displayed.
3. AI Disclaimer and Limitations
You acknowledge and agree that Saivy's AI-generated results may not always be accurate, complete, or current. Specifically:
- AI-generated results may contain errors, inaccuracies, or outdated information.
- Plan details, pricing, inclusions, and availability displayed by Saivy may differ from what is currently offered by the provider.
- Saivy does not guarantee the accuracy, completeness, reliability, or timeliness of any information presented.
- AI models may misinterpret, omit, or incorrectly rank plan features.
- Results are generated based on the information you provide and publicly available data at the time of your search. Changes to provider offerings may not be immediately reflected.
You must always verify plan details, pricing, terms, and conditions directly with the relevant provider before making any decisions.
4. Not Financial or Professional Advice
Saivy is an information tool only. It does not provide financial advice, personal advice, or recommendations within the meaning of the Corporations Act 2001 (Cth) or any other Australian legislation.
- The information and comparisons provided by Saivy do not constitute a recommendation to purchase, switch to, or cancel any particular plan or service.
- Saivy does not take into account your complete personal or financial circumstances, objectives, or needs.
- You should always consider your own individual circumstances, including your budget, usage patterns, location, and specific requirements, before deciding which plan to use.
- Where appropriate, you should seek independent financial, professional, or legal advice before making decisions based on information provided by Saivy.
Saivy's purpose is to make plan information easier to find and compare — the decision of which plan to choose is always yours.
5. User Responsibilities
When using Saivy, you agree to:
- Provide accurate and truthful information when performing searches.
- Independently verify all plan details with the relevant provider before switching or signing up.
- Not rely exclusively on Saivy's AI-generated output when making decisions about your bills or plans.
- Accept full responsibility for any decisions you make based on information obtained through Saivy.
- Use the Service in compliance with all applicable Australian laws and regulations.
6. Misuse of AI and Prohibited Conduct
You must not:
- Use automated scripts, bots, or other programmatic means to access the Service beyond normal personal use.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or data processing logic.
- Deliberately input false, misleading, or malicious data to manipulate or exploit AI outputs.
- Circumvent, bypass, or attempt to bypass rate limits, usage restrictions, or other technical safeguards.
- Use the Service to scrape, harvest, copy, or redistribute Saivy's data, comparison results, or content for commercial purposes.
- Use the Service in any way that could damage, disable, overburden, or impair our infrastructure.
- Resell, sublicense, or provide access to the Service to third parties without our written consent.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
We reserve the right to suspend or terminate your access immediately if we reasonably believe you are engaging in any prohibited conduct.
7. Rate Limiting and Usage Tiers
Saivy operates on a tiered usage model to ensure fair access for all users:
- Free tier: limited to 3 plan searches per week, with access to mobile plan comparisons only.
- Pro tier: increased search limits and access to all service categories (mobile, internet, health insurance, energy) as described on our Pricing page.
We reserve the right to modify usage limits, introduce new tiers, or adjust rate limiting at any time. We will provide reasonable notice of material changes to paying subscribers.
8. Subscriptions and Payments
- Pro subscriptions are billed on a monthly or annual basis, as selected at the time of purchase.
- Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
- You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access to Pro features until that date.
- Refunds are not provided for partial billing periods, except where required by Australian Consumer Law.
- We reserve the right to change subscription pricing with reasonable notice to existing subscribers.
9. Intellectual Property
All content, features, functionality, software, AI models, branding, trademarks, and design elements of Saivy are the exclusive property of Saivy and are protected by Australian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
- Saivy does not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
- Saivy is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- Saivy is not liable for any loss, damage, or cost arising from your reliance on AI-generated results, including but not limited to financial loss from switching plans based on inaccurate information.
- Where liability cannot be excluded, our total aggregate liability to you is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
11. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any similar state or territory legislation that cannot be excluded, restricted, or modified by agreement.
If any provision of these Terms is found to be inconsistent with the Australian Consumer Law, that provision shall be read down or severed to the extent necessary to ensure compliance.
12. Indemnification
You agree to indemnify, defend, and hold harmless Saivy and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Service.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any decision you make based on information obtained through the Service.
13. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe that:
- You have violated these Terms.
- You are engaging in prohibited conduct (see Section 6).
- Your use of the Service poses a risk to other users or our infrastructure.
- We are required to do so by law.
Upon termination, your right to use the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination will remain in effect.
14. Dispute Resolution
If you have a dispute arising from or relating to these Terms or the Service, we encourage you to contact us first at the details below so we can attempt to resolve the matter informally.
If informal resolution is unsuccessful, the dispute will be resolved in accordance with the laws of New South Wales, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. For Pro subscribers, we will also notify you via email for significant changes.
Your continued use of Saivy after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
